Agreement

These Terms govern your use of NAVIDAD websites and marketing materials. Use of production cloud services is governed by a separate order form and data processing agreement executed between your organisation and NAVIDAD. By accessing or using our websites, you agree to these Terms.

Acceptable use

You agree not to misuse the services, attempt unauthorised access, interfere with security or availability, or use the platform in violation of applicable law—including healthcare privacy and data protection rules. You are responsible for maintaining the confidentiality of your account credentials.

Intellectual property

NAVIDAD and its licensors retain all rights in the software, documentation, trademarks, and branding. Customers retain ownership of their data uploaded to or generated within the platform, subject to the subscription agreement. Nothing in these Terms transfers ownership of intellectual property.

Disclaimer

Marketing pages describe intended capabilities; specific features, availability, and performance depend on your plan, configuration, and applicable regulations. Website content is provided for informational purposes only. The platform is provided "as available" to the extent permitted by applicable law, without warranties of any kind except as expressly stated in your subscription agreement.

Limitation of liability

To the maximum extent permitted by applicable law, NAVIDAD's aggregate liability to you for any claims arising out of or related to these website Terms is limited to the greater of (a) amounts paid by you in the twelve months preceding the claim or (b) one hundred US dollars. This limitation does not apply to liability that cannot be excluded by law, including fraud or wilful misconduct.

Governing law

For production healthcare service agreements, governing law, jurisdiction, and dispute resolution are defined in your executed order form. For website-only use, these Terms are governed by the laws of the Republic of India, and disputes shall be subject to the exclusive jurisdiction of courts in Bengaluru, Karnataka, India.
